1. Acceptance of Terms

By creating an account, placing an order, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Kaneats.

2. Description of Services

Kaneats is a food delivery platform that connects users with local restaurants and delivery drivers. We facilitate food ordering, payment processing, and delivery coordination. We do not prepare, cook, or deliver food ourselves—we act as an intermediary between you, restaurants, and independent delivery contractors.

3. User Accounts

- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use our Services.

- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

- You agree to provide accurate, current, and complete information when creating an account and to update such information as necessary.

- You may not create multiple accounts, transfer your account to another person, or use another person's account without authorization.

4. Orders and Payments

- Order Placement: When you place an order through our Services, you are making an offer to purchase food from the selected restaurant. We will send you a confirmation email, but acceptance occurs when the restaurant confirms your order.

- Pricing: Menu prices are set by restaurants and may vary. We may add service fees, delivery fees, taxes, and tips. All prices are displayed in Canadian dollars unless otherwise stated.

- Payment: You agree to pay all charges associated with your orders, including applicable taxes and fees. Payment is processed securely through third-party payment processors.

- Refunds: Refund policies vary by restaurant and situation. Contact customer support for assistance with refund requests.

5. Cancellation and Refunds

- You may cancel an order before the restaurant begins preparation, subject to restaurant policies.

- Once a restaurant has begun preparing your order, cancellation may not be possible, and refunds are at the restaurant's discretion.

- If you receive incorrect, damaged, or unsatisfactory food, please contact customer support immediately. We will work with the restaurant to resolve the issue, which may include refunds or re-orders.

6. Delivery

- Delivery times are estimates and not guaranteed. Actual delivery times may vary based on factors including weather, traffic, and restaurant preparation times.

- You are responsible for providing accurate delivery addresses and contact information. Kaneats is not liable for orders delivered to incorrect addresses due to user error.

- Delivery drivers are independent contractors, not employees of Kaneats. They are responsible for safe delivery of your order.

7. User Conduct

You agree not to:

- Use our Services for any illegal or unauthorized purpose.

- Violate any local, provincial, or federal laws or regulations.

- Interfere with or disrupt the Services or servers connected to the Services.

- Impersonate any person or entity or misrepresent your affiliation with any person or entity.

- Harass, abuse, or harm other users, restaurant partners, or delivery drivers.

- Use automated systems or bots to access the Services without permission.

8. Intellectual Property

All content on our Services, including text, graphics, logos, images, software, and other materials, is the property of Kaneats or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Kaneats, its affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of or inability to use our Services. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

10. Disclaimers

- We provide our Services "as is" and "as available" without warranties of any kind, either express or implied.

- We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses or other harmful components.

- We are not responsible for the quality, safety, or legality of food provided by restaurants, or for the actions of delivery drivers.

- Restaurants are solely responsible for food preparation, quality, and compliance with food safety regulations.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kaneats, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause or notice, for any reason including violation of these Terms. You may terminate your account at any time by contacting customer support or using account deletion features in your dashboard.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the laws of Ontario, Canada, unless prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through notices on our Services. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
